End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a binding contract between you ("User", "you") and Wattz Mobility Sdn. Bhd. (SSM Registration No. 202401030182 (1576031-V)) ("Wattz", "we", "us", "our"), governing your use of the Wattz website, mobile application, and related services (collectively, the "Platform").

By creating an account or using the Platform, you agree to this Agreement. If you do not agree, do not use the Platform.

1. Definitions

• Platform — the Wattz website, mobile application, and associated services for peer-to-peer (P2P) electric vehicle (EV) rentals.

• Host — a user who lists a vehicle for rent.

• Renter — a user who books a vehicle.

• Content — any data, text, images, or material uploaded to or generated on the Platform.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose, subject to this Agreement. This license does not transfer any ownership rights in the Platform or its software.

3. Eligibility

• To rent, you must be at least 21 years old and hold a valid driver's license.

• To host, you must be at least 18 years old and verify vehicle ownership.

• You must provide accurate, current, and complete information.

4. User Accounts

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately at support@wattz.my of any unauthorized use.

5. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of Malaysian law.

• Misrepresent your identity, vehicle ownership, or eligibility.

• Interfere with, disrupt, reverse-engineer, or attempt to gain unauthorized access to the Platform.

• Upload malicious code or infringe the intellectual property rights of others.

6. Bookings, Payments, and Fees

• Rental bookings, fees, deposits, and payouts are processed through our third-party payment processors.

• You authorize us to charge applicable fees, deposits, and charges to your selected payment method.

• Host payouts are subject to verification and any applicable holdbacks for disputes or damages.

7. Host and Renter Obligations

• Hosts must ensure listed vehicles are roadworthy, insured, accurately described, and legally permitted for rental.

• Renters must operate vehicles lawfully, return them in the agreed condition, and report any damage or incidents promptly.

8. Insurance and Liability

Insurance coverage, claims, and damage responsibilities are governed by the applicable rental terms and insurance policy in force at the time of booking. Wattz is a platform facilitating P2P rentals and is not the owner or operator of listed vehicles.

9. Intellectual Property

All Platform software, branding, and content (excluding User Content) are owned by or licensed to Wattz. You may not copy, modify, distribute, or create derivative works without our written consent.

10. User Content

You retain ownership of Content you upload. You grant Wattz a non-exclusive, royalty-free license to use, host, and display such Content as necessary to operate the Platform.

11. Third-Party Services

The Platform integrates third-party services (including payment processors, insurance providers, and accounting integrations such as Intuit QuickBooks). Your use of those services may be subject to their respective terms.

12. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by Malaysian law. We do not warrant uninterrupted or error-free operation.

13. Limitation of Liability

To the maximum extent permitted by law, Wattz shall not be liable for indirect, incidental, special, or consequential damages. Our total aggregate liability shall not exceed the total fees you paid to Wattz in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold Wattz harmless from claims, damages, and expenses arising from your use of the Platform or breach of this Agreement.

15. Suspension and Termination

We may suspend or terminate your account for breach of this Agreement, unlawful activity, or risk to other users. You may terminate by closing your account at any time.

16. Privacy

Your use of the Platform is also governed by our Privacy Policy at [INSERT PRIVACY POLICY URL], which is incorporated into this Agreement by reference.

17. Changes to This Agreement

We may update this Agreement. We will post the updated version and revise the "Last updated" date. Material changes will be notified by email or in-app notice. Continued use constitutes acceptance.

18. Governing Law and Jurisdiction

This Agreement is governed by the laws of Malaysia. You submit to the exclusive jurisdiction of the courts of Malaysia.
